fireTMS PRIVACY PRINCIPLES

Data security in the TLS industry is of tremendous importance, so we make every effort to ensure that the privacy of our customers and website users is treated with full respect and protected in accordance with applicable standards. Below are the principles we follow.

  1. Since our customers place their trust in us, we always use their data fairly and transparently.
  2. Any person who has entrusted us with their personal data has the right to be fully informed about how we use their personal data. We are happy to inform you about the data we collect, how we use it and to whom we transfer it, and we provide information about entities to contact if our knowledge may turn out to be insufficient.

Definitions

Administrator – this is us, fireTMS.com Sp. z o. o. with its registered office in Rybnik, ul. 3 Maja 30, 44-200 Rybnik, registered in the Register of Entrepreneurs kept by the District Court in Gliwice, X Economic Department of the National Court Register under KRS number 0000767863, NIP: 8961583774.

Personal Data – This is all customer and user data defined in accordance with the GDPR and the Personal Data Protection Act which you import into the fireTMS Program, or forward to us via the Program or Website.

fireTMS/Program – You use it to handle transport and forwarding orders and related documents. It is an IT system available online at https://app.firetms.com/, operating in the Software as a Service model (you do not have to install it on your computer), which is provided by the data controller.

Account – This is an individual profile that will be created for you the first time you log in to the Program. Through the account you are able to use the functionality available to you and the resources of the Program;

Policy – A set of principles, rules and our experience concerning the Processing of Personal Data you are reading just now;

Program – An IT system available online at https://app.firetms.com/, via modern web browsers, operating in the Software model as a Service (you do not need to install it on your computer). You can use it to handle transport and forwarding orders and related documents;

Processing – This is the operations we perform on Personal Data. Processing means activities such as collecting, recording, storing, developing, changing, sharing and deleting Personal Data, in particular those operations that lead to the optimal use of the Program;

Terms and Conditions – A document which defines the terms of using the Website and the Program. You can read the current version of the Terms and Conditions by clicking here;

Website – Our company website at www.firetms.com;

GDPR – Regulation 2016/679 (EU) of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC;

Act – This is the Polish Act of 10th May 2018 on the protection of personal data.

Undefined and capitalised terms have the meaning given to them by the fireTMS service Terms and Conditions, available at the Internet address: https://firetms.com/pl/terms-of-service (hereinafter: Terms and Conditions).

We can be helpful thanks to your information

When you are browsing Web pages our servers automatically collect information sent by your browser and this contained in the system logs. This information may include such data as: e-mail addresses, IP addresses, browser type, website visited immediately before entering our website or the Program, and other data. The data collected about the users of the Website do not allow their direct or indirect identification.

fireTMS uses this data only to adjust the displayed content in order to ensure the highest quality of services provided, as well as for statistical, technical, advertising and functional purposes. This allows us to individually adjust the Website to your needs.

We respect your choice, therefore providing Personal Data is always voluntary. Remember, however, that if you do not provide the Personal Data we have asked for, we will not be able to adjust the content displayed to you, send you the desired information or conclude contracts with you.

We have been improving the Website and the Program all the time, therefore, when using them, various information about viewers, including you, may be automatically collected.

We may also use cookies for this purpose.

The Website does not always automatically collect information about you, but if it does, we will always inform you about it.

We want to know your needs

For our cooperation to run smoothly, we need to get to know each other. You already know everything about us, and if you want to know more, contact us using the contact details provided at the end of the Policy.

We want to get to know you better, therefore:

  1. when you are using the Website, we collect data about you: (a) IP address, (b) domain, (c) browser identification data, (d) operating system type and (e) location;
  2. when you are contacting us via the forms available on the Website, we may ask you for the following data: (a) e-mail address (b) data provided in the message for the purpose of handling your enquiry; 
  3. when the Program is used, information is automatically collected on the activities performed by the Program user in order to recreate the history, for smooth technical support, and for statistical purposes;
  4. when using our social network sites (Linkedin, Facebook, Instagram), data (location, IP, operating system) is automatically collected for statistical and advertising purposes. One of the most important is to show you the content you are interested in and targeted ads.
  5. if you fill in the contact form included in an ad on Facebook or Linkedin, we may ask you for the following data: (a) first name (b) surname (c) e-mail address (d) telephone number (e) company name, for the purpose of handling your enquiry or responding to your complaint; 
  6. for the purpose of registering your account, we will ask you for the following data, including personal data: (a)  e-mail address, (b) country, (c) company name, (d) telephone number. After registering your account, you can enter other data (including personal data) into the system, also the data which you are the controller of (e.g. data of your customers, drivers): (a) first name, (b)  surname, (c) company name, (d) address, (e) data identifying your company, i.e. NIP, REGON, KRS, (f) e-mail address, (g) telephone number;
  7. we need your e-mail address in order to send you our newsletter; 
  8. when using the fireTMS Driver application, we collect your data: (a) user’s phone number, (b) location;
  9. in addition, your personal data may be shared based on your consent and with your knowledge with our business partners for sales and marketing purposes, as well as whenever necessary for the execution of concluded agreements and proper customer service based on the legitimate interests pursued by the Data Controller.

Providing personal data is voluntary; it is up to you to decide whether you want to contact us via the form on the Website, via social media or if you want to be kept up to date via the newsletter. It is also up to you whether you create an account in the Program or whether you use the fireTMS Driver application. However, please remember that it is necessary to provide your personal data, without it we will not be able to respond to your enquiry, maintain your account in the Program or send you a newsletter.

When you provide us with Personal Data, we become data controller within the meaning of Art. 4 para. 7 GDPR.

Your Personal Data are processed by us:

  • on the basis of Article 6(1)(a) of the GDPR – in the event that you voluntarily consent to the processing of personal data. This consent is expressed, in particular, by ticking the check box next to the statement of consent to the processing of personal data;
  • on the basis of Article 6(1)(b) of the GDPR – in order to perform the contract (to enable you to use the Program) or when it is necessary to take action prior to the conclusion of the contract at your request;
  • on the basis of Article 6(1)(c) of the GDPR – on the basis of legal regulations, in particular in order to fulfil obligations arising from fiscal regulations, as well as to respond to complaints;
  • on the basis of Article 6(1)(f) RODO – on the basis of the Controller's legitimate interest; the legitimate interest is, in particular, direct marketing of our products or services, servicing of queries addressed to us, as well as protection against claims.

The data of our customers is processed until the completion of the contract, however, subject to the possibility of further use of these data, such as:

  • necessary to pursue claims arising from the performance of the contract;
  • necessary for the purposes of advertising, market research and researching the behaviour and preferences of the Website customers/users, with their consent;
  • admitted for processing on the basis of separate laws or an agreement.

Where consent is the basis for the processing of personal data, the data is processed until the consent is withdrawn. You may withdraw your consent to the processing of personal data at any time, but this will not affect the legitimacy of the processing of personal data prior to withdrawal.

We process your Personal Data:

  1. to provide and maintain the Platform and your account; 
  2. to contact you;
  3. to answer questions and complaints
  4. to send information regarding changes to the Terms and Conditions, etc.
  5. to adjust the Website to your needs
  6. for marketing purposes – sending you our own commercial information. We always ask for your consent before sending such information. All you have to do is tick the appropriate field in the form when filling out the contact forms;
  7. for fireTMS statistical purposes

You decide about your Personal Data

Please note that in relation to our processing of your personal data you have the right to:

  • access your data;
  • rectify, delete or restrict the processing of your data; 
  • object to the processing of your data, where the processing is based on the legitimate interests of the Controller; 
  • withdraw consent to the processing of your data.

If you find that the way we process your personal data violates the provisions of the GDPR, you have the right to lodge a complaint with the supervisory authority – the President of the Office for Personal Data Protection.

How we share information

Due to the specificity of our business, we may sometimes transfer or share your Personal Data with other entities. Such transfer may only take place after we have concluded a contract with another entity. We always ensure that the entities to which we transfer your personal data meet the highest security standards in order to provide adequate protection.

Personal data is provided only if it is necessary for the proper operation of the Program, the Website, processing for statistical purposes in the optimization of marketing content in connection with the components implemented within the contact form and the Controller. In particular, suppliers of legal, accounting and postal services, as well as external service providers such as Google, Call Page Sp. z o.o. (full list available upon request) are among the recipients of the data.

Your personal data may also be provided in accordance with applicable law at the request of an authorised authority (court, police, prosecutor, office or other state authorities). Your personal data may be transferred to countries outside the European Economic Area only if those countries meet the personal data security requirements set out in the GDPR. If it becomes necessary to transfer personal data outside the European Economic Area, we will transfer the data in accordance with applicable law.

The data collected in accordance with the Policy is valuable research material, therefore we can create and disclose anonymous statements and statistical data on the operation of the Website. However, such statements are not Personal Data, and thus do not allow for any identification of you or other users.

Furthermore, due to the fact that we currently contribute to the Inelo Group, we may transfer your personal data, as well as the personal data you authorise us to process, to entities of the Inelo Group, in particular to the entity INELO Polish company with limited liability with its registered office in Bielsko-Biała, (43-300), ul. Karpacka24/U2b, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Bielsko-Biała, the VIII Commercial Division of the National Court Register under KRS number 0000702969, NIP number 5512333463 and REGON: 356687662. The above is justified by the fact that we are constantly improving the quality of the services we provide, as well as ensuring consistency of service to our customers within the group. The sharing of your personal data takes place on the basis of a legitimate interest pursued by the Data Controller, while in the case of personal data that you entrust to us, further entrustment of personal data processing applies. Your personal data may also be shared with Inelo Group entities for commercial and marketing purposes based on your consent or legitimate interest.

Your data security

We care about the security of all Personal Data entrusted to us, therefore we apply very high security systems and keep confidential all information provided. We fulfil all obligations incumbent on us as the data controller, resulting from the provisions of generally applicable law and justified by our experience.

In order to ensure security:

  1. we use SSL encryption,
  2. we control the methods of collecting, storing and processing information, including physical security measures, to protect against unauthorised access to the system,
  3. we provide access to personal data only to employees, contractors and representatives who must have access to them in order to process them for the controller’s needs. Furthermore, under the contract, they are obliged to maintain strict confidentiality, and in the event of failure to fulfil these obligations, they may suffer consequences, including termination of cooperation.

fireTMS does not share the collected data with third parties, except for situations where it is required by the provisions of generally applicable law, i.e. based on a request of an authority or court authorised to do so. Your Personal Data are therefore processed by fireTMS, inter alia, in connection with servicing concluded contracts, for the time necessary to provide services and for the period in which it is possible to pursue claims in connection with the services provided. If data processing is based on a consent, fireTMS will use this data until its withdrawal. At the same time, for accountability purposes, fireTMS will store data for the period in which they are obliged to keep data or documents containing them to document the fulfilment of legal obligations, including enabling control of their performance by public authorities.

Only common deliberation protects your personal data

Remember that in order for your Personal Data to be safe, you must also take care of it yourself. Therefore, always keep your login details to the Program, both password and login, confidential.

If you share your workstation (computer) with another person, remember to log out each time after using the Program.

Cookies

We want to improve our website, facilitate the use of it and best adapt it to your needs, therefore, in addition to the information you voluntarily provide, we use cookies, i.e. files containing IT data that are saved on the end device you use, so that it is possible to read them when you use the Website again.

Cookies serve you and us. Their purpose is to adapt the content of the Website to your individual preferences, optimise the use of the Website and its individualisation. Thanks to cookies, we can create statistics on the use of the Website, which allows us to constantly improve it.

Cookies do not cause any changes to the configuration of the end device used by you. This information is used only to create statistics on the functioning of the Website. They may also be made available to external entities, but only when required by law or in the case of entrusting the processing of information about cookies to external entities. We use several types of cookies on Website:

  1. Service:

a) Essential: these are cookies that enable the proper functioning of the Website and its basic functions. The website cannot function without these cookies.

b) Preferential: these are cookies related to user preferences. Thanks to them it is possible to remember on the website such information as the language or the region in which the user is located.

c) Statistical: These are cookies that help collect data so that the owner of the website knows how users use the website. This data helps to improve the content of the website.

  1. Marketing: these are cookies used by the owner of the website and its partners in order to display and adapt advertising content to the users' preferences.
